नई दिल्‍ली । दिल्ली के राउज एवेन्यू कोर्ट(Rouse Avenue Court, Delhi) ने मुख्यमंत्री अरविंद केजरीवाल(Chief Minister Arvind Kejriwal) को जमानत(Bail) देते हुए कहा कि ईडी ने केजरीवाल (ED summons Kejriwal)के खिलाफ मनी लॉन्ड्रिंग केस में कोई प्रत्यक्ष सबूत सामने नहीं रखे हैं। जांच कितने समय तक चलेगी इस बात का जवाब देने में भी ईडी विफल रही। स्पेशल जज न्याय बिंदु ने कहा कि प्रथम दृष्टया उनका अपराध अभी तक स्थापित नहीं हुआ है।

आखिर जांच कब तक
न्यायाधीश ने कहा कि लाइसेंसधारकों के पक्ष में दिल्ली की शराब नीति में हेरफेर करने के लिए राजनेताओं, व्यापारियों और अन्य लोगों के एक कार्टेल साउथ ग्रुप से 100 करोड़ रुपये की रिश्वत लेने का आरोप लगाया गया है। इस पैसे का इस्तेमाल 2022 के गोवा विधानसभा चुनाव में किए जाने का आरोप है, लेकिन ईडी यह स्पष्ट करने में विफल रही है कि पूरे पैसे के लेन-देन का पता लगाने के लिए उसे कितना समय चाहिए। इसका मतलब यह है कि जब तक ईडी द्वारा शेष राशि का पता लगाने की यह कवायद पूरी नहीं हो जाती, तब तक आरोपी को सलाखों के पीछे ही रहना होगा। अदालत ने अपने आदेश में कहा कि आवेदक की ओर से बताया गया है कि जुलाई 2022 में ईडी के पास सामग्री पहले से ही उपलब्ध थी, लेकिन उन्हें अगस्त 2023 में बुलाया गया जो उनकी दुर्भावना को दर्शाता है। उन्होंने ईडी के इस तर्क को भी खारिज कर दिया कि जांच एक कला है और कभी-कभी एक आरोपी को जमानत और माफी का लॉलीपॉप दिया जाता है। उन्हें अपराध के पीछे की कहानी बताने के लिए कुछ आश्वासन दिया जाता है।

पीएमएलए में जमानत को असंभव बना दिया
अदालत ने कहा कि पीएमएलए के तहत मामलों में जमानत प्राप्त करना एक असंभव कार्य बन जाता है, क्योंकि किसी न किसी बहाने से जांच एजेंसी कुछ न कुछ कारण बताती है, जो आरोपी को बिना किसी उम्मीद के लगभग एक दोषी के समान स्थिति में डाल देती है। पीएमएलए के तहत दो शर्तों पर जमानत है। पहली शर्त की आरोपी प्रथम दृष्टया मामले में निर्दोष हो, वहीं दूसरी शर्त, जमानत के दौरान अपराध में शामिल न होने की। पहली शर्त के लिए अभी तक अरविंद केजरीवाल पर दोष साबित नहीं हुए हैं, वहीं दूसरी शर्त की अंडरटेकिंग पहले ही दी जा चुकी है।

इन बिंदुओं पर मिली जमानत
अदालत ने कहा कि यह संभव हो सकता है कि आवेदक को जानने वाले कुछ लोगों की किसी अपराध में संलिप्तता हो, लेकिन ईडी अपराध की आय के संबंध में आवेदक के खिलाफ कोई प्रत्यक्ष सबूत देने में विफल रहा है। उन्होंने इस दावे पर ईडी की चुप्पी पर भी सवाल उठाया कि उन्हें कथित शराब नीति घोटाले से संबंधित मनी लॉन्ड्रिंग केस में सीबीआई एफआईआर या एंटी-मनी लॉन्ड्रिंग एजेंसी द्वारा दर्ज ईसीआईआर में नामित किए बिना गिरफ्तार किया गया था।

अपराध की आय का अब तक पता नहीं
अदालत ने कहा कि ईडी इस तथ्य के बारे में चुप है कि गोवा विधानसभा चुनावों में ‘आप’ द्वारा अपराध की आय का उपयोग कैसे किया गया है। क्योंकि, माना जाता है कि लगभग दो वर्षों के बाद कथित राशि के बड़े हिस्से का पता लगाना बाकी है। ईडी ने बहस के दौरान बताया कि लगभग 40 करोड़ की आय को ट्रैस किया गया है। इस पर अदालत ने कहा था कि दो साल में 60 प्रतिशत आय भी ट्रेस नहीं की जा सकी।

● एक लाख रुपये के निजी मुचलके और इतनी ही राशि के जमानती पर दी जमानत

● आवेदक बिना अदालत की अनुमति के देश छोड़ कर नहीं जाएगा
